According to a recent news feature from Yahoo Sports, Texas Rangers relief pitcher, Jeremy Jeffress, was arrested for drunk driving last Friday, and authorities have said he allegedly urinated on himself during the incident.

dJCgskAuthorities say the arrest occurred around two in the morning in the Uptown neighborhood of the city.   The police initiated the stop after he allegedly changed lanes without using a turn signal and nearly hit a police cruiser. When officers approached his car and looked inside, they allege that they immediately detected the odor of an alcoholic beverage and that his eyes were bloodshot, glassy, and watery.  He allegedly told officers that he had three or four drinks of Hennessey and coke. According to a recent news feature from Fox News, a man was celebrating his 34th birthday with a group of friends at a local hotel where the group was having a party.  San Diego Police say that the party-goers had been drinking that evening.

thirstyAt some point in the night, a female friend of the man decided she wanted to leave the party and would be driving her car home.  For reasons that are not made clear in the police account, the man decided he did not want her to leave the party.  It is not known if he was concerned about her possibly driving her car while drunk or whether he wanted her to stay for other reasons. When we think of traffic violations involving traffic lights, we typically think of running a red light.  However, according to a recent news feature from the La Crosse Tribune, a man was ultimately arrested and charged with a felony after a law enforcement officer witnessed him stopped at green traffic signal instead of driving through, as one is supposed to do.

green-light-texture-1187390You might be wondering why a police officer or sheriff’s deputy would have valid probable cause to pull someone over for stopping at green light.  The reason for this is because waiting at green light for an unreasonable amount of time is one of the many clues that a driver may be operating his or her motor vehicle under the influence of intoxicating liquor or drugs. These clues were developed, or more properly observed, by the National Highway Traffic Safety Administration (NHTSA) after decades of roadside observations. Continue reading

In the past couple of months, we have seen far too many incidents of people being arrested after being involved in an accident in a work zone in the Greater Boston area and throughout the Massachusetts.  While even a single drunk driving accident is one too many, we have seen around half a dozen drunk driving accidents in Boston and Revere, and state officials are trying to do whatever they can to stop this. We have already seen increased safety patrols by Revere Police, Chelsea Police, Boston Police and the Massachusetts State Police (MSP).

roadconstruction2Now, according to a recent news article from the Boston Globe, the state has just launched a new campaign to make it safer for highway workers and curb this recent blight of drunk driving incidents in the Commonwealth. The recent effort is said to be a “two-pronged” campaign.  The campaign will focus on educating the public about the dangers of drunk driving and increasing drunk driving patrols in work zones.  Both of these prongs are designed to save lives and keep workers and others on our streets and sidewalks safe from drunk drivers. According to a recent news feature from Medical Daily, a new study published in the Lancet Gastroenterology & Hepatology, alcohol consumption is reducing worldwide, and this may be a result of newer low alcoholic beers now popular on the market.

Our hope is that if people are drinking less, there will be less drunk driving incidents, which in turn will result in less drunk driving accidents and fewer alcohol-related fatalities.

beergardenThe data was derived from a Canadian organization that studies addiction and mental health. Their claim was that drinking beer with lower ethanol content would mean that people will have a lower blood alcohol content (BAC) in their respective blood streams, and this will result in less drunk driving accidents. Judges often say during sentencing that drunk driving is not like a lot of other crimes.  The reason for this is because it is a serious crime that can, and often does, result in the death of innocent victims that is often not taken seriously and often committed by a person who is otherwise not a typical criminal.  Not only that, it is one of the few crimes that a person who otherwise has no issues in their life will commit multiple times, even though it is costing them everything they have worked for.

mf1GjqGThere are a variety of reasons for this.  In many cases, especially with younger people, it is often seen as not a big deal, and something that everyone does.  In some cases, a drunk driver is someone who makes bad decisions, but not necessarily someone who made a bad choice, and was negligent, but is not what we would typically describe as an alcoholic.  However, in other cases, the drunk driver is an alcoholic and drives drunk on a regular basis, despite the tremendous risk to themselves and others. Despite what many people think, drinking and driving is not a crime.  It is perfectly legal for someone to have a beer and then get behind the wheel of a car and drive, so long as their blood alcohol content (BAC) is not at or above the legal limit of 0.08 or they are not otherwise intoxicated even at a lower limit.

mWkbC9MThe limit of 0.08 grams of ethanol (drinking alcohol) per hundred milliliters of blood was imposed in all states in 2000 through a federal law, even though the vast majority of states had already adopted the standard by that time.  However, some states still maintained their legal limit at 0.10, which is actually significantly higher that the current legal requirement, as 0.02 can have a major effect on one’s level of intoxication with respect to the ability to safely drive a motor vehicle. As you may recall, Melrose Place actress Amy Locane-Bovenizer was found guilty in connection with a fatal drunk driving accident that occurred in 2010 in New Jersey.  In that accident, there were multiple cars involved and a victim was killed.  During her trial, defendant attempted to blame another driver for the deadly results but did not deny that she was drunk driving at the time of the accident.

prison-1431136-mShe was eventually found not guilty of the lead charge of aggravated manslaughter, but she was found guilty of the lesser included offense of second degree vehicular homicide. Court records indicate that she was driving nearly 20 miles per hour over the posted limit and had a blood alcohol content (BAC) of around three times the legal limit of 0.08 grams of ethanol per 100 milliliters of blood.   Continue reading

These days, most people in Boston are familiar with Uber, Lyft, and possible other so-called ride sharing companies. For those that are not aware, you call for a ride on your smart phone via the company’s app and are told how long it will take for a driver to get to you.  You generally have a choice as to whether you want a black car similar to what people take to the airport for business trips or if you want a regular marked taxi, or a private vehicle driven by one of the company’s non-professional drivers.

barsignAs one might expect, this new business model makes licensed taxi drivers and other professional drivers and their respective employers very upset because it was costing them a lot of business.  They were also arguing that the new drivers did not need to pass official background checks or show a knowledge of the area and how to get to places around the city.  For example, many cab drivers are required to pass a map test whereas many Uber drivers clearly have no idea where they are going without assistance from the customer. According to a recent news feature from CBS Local Boston, a Revere man was charged in connection with a drunk driving accident that allegedly occurred at a roadside construction site.  What’s especially concerning about this situation is that there have been more than five accidents with injuries in construction zones in the Revere and Boston areas. What’s more, this is not the only one that involved a suspected drunk driver.

In fact, this motorist is the fourth drunk driving suspect that crashed in a Mass Department of Transportation (MassDOT) work site.

roadconstruction2We have seen construction workers injured and a police cruiser destroyed so far, and the Massachusetts State Police (MSP) are concerned, especially since they have a barracks right near the site of the construction on Revere Beach Boulevard. Continue reading
