Donald Middleton of Texas was known by local authorities in Houston, TX to drink to excess and then get behind the wheel of a motor vehicle. But it wasn’t his first conviction that stopped him. It wasn’t even his second, third or fourth. driving3

In fact, as The New York Times reported, Middleton had eight prior convictions and still technically had a driver’s license that was valid. But now, after his ninth conviction, not only did the judge revoke his driver’s license for life, she sentenced him to life in prison. The 56-year-old won’t be eligible for parole until he’s 86-years-old – 30 years from now.

Of course, we know that repeat DUI offenders pose a substantial threat on the road. According to Mothers Against Drunk Driving (MADD), one-third of all drivers arrested and convicted of drunk driving are repeat offenders. AAA DUI Justice Link reports that the risk of a driver with one or more DUI convictions becoming involved in a fatal crash is 1.4 times higher than for a driver who has no prior DUI convictions.  Continue reading

Massachusetts state police are beefing up their patrols near highway work zones, particularly in areas with high rates of drunk driving crashes and arrests. The decision, reported by The Boston Globe, comes just days after a road construction crew was mowed down by a drunk driver for the fourth time in just 10 days. roadconstruction2

A state police spokesperson said the problem is not the layout of the road construction zones or the safety measures that are used to protect the road construction crews. Rather, the problem is that people are driving drunk and under the influence of drugs. He called these drivers’ actions “irresponsible” and “reckless,” and is a reflection of the bigger problem of impaired driving, which is amplified to some degree in construction zones, where there may be more obstacles, people working close to the roadside and somewhat unpredictable traffic patterns.

Authorities say they intend to increase patrols, and they will additionally be conducting sobriety checkpoints in and near construction zones. Federal and state grants will help to pay for these additional enforcement actions.  Continue reading

Ray Bourque, a former member, and star, of the Boston Bruins was just arrested on suspicion of driving drunk according to a recent news feature from the Boston Herald.  Bourque, who is currently 55-years-old, was charged with tailgating (following too closely), operating a motor vehicle under influence of intoxicating liquor or drugs, and for being in a construction zone at the time of the accident.

one-car-key-1149771-mPolice in Andover allege that Bourque was under the influence of alcohol while tailgating a Mercedes- Benz minivan.  Fortunately, it does not appear that anyone was injured as result of this alleged drunk driving car accident in Boston. Continue reading

Sure, they call it the “drive-in,” but they don’t mean it literally. drivein

Police in Weymouth, Massachusetts say that’s what happened recently when a drunk driver crashed into a drive-in restaurant and then took off.

The collision occurred around 2:45 a.m. at Jenna’s Drive-In. The fire department first received word of a problem when a resident awoke to see a vehicle on fire in his front lawn. The resident rushed outside and spotted the driver, looking dazed still in the driver’s seat. The resident shouted to ask if he was Ok. The driver then reportedly “just took off” on foot. The resident said he tried to stop him, but was unsuccessful. Authorities found the 29-year-old walking along a road a short distance away.

He was charged with DUI (second-time offense), and operating under the influence without a driver’s license.

It’s estimated the collision caused some $2,000 in property damage, though thankfully, no one was injured. Continue reading

According to a recent news feature from the Boston Herald, a defendant who was convicted of killing a sister and brother in a deadly hit-and-run car accident in Worcester has just been sentenced and could spend the next 11 years in a Massachusetts Correctional Institute (MCI).

rosesThe 31-year-old defendant had recently pleaded guilty to operating a motor vehicle under the influence of intoxicating liquor (OUI) and vehicular manslaughter.  The hit-and-run crash to which he pleaded guilty resulted in death of a 46-year-old man and his sister who was two years older than him.  The accident happened outside of the brother’s home.  At the time they were hit by defendant, they were taking groceries out of his car. Every drunk driving trial, especially ones involving a serious alcohol-related crash that resulted in a serious person injury, should be taken seriously.  Many of these cases will even make the news as a part of a brief public safety story.  However, when a state trooper is arrested for drunk driving following a serious crash, the case can take on a different shape and can become much more newsworthy to the general public.   However, it should be noted that every drunk driving crash is of the highest importance to the victims and their families.

gavel4A recent news article from the Eagle-Tribune involves a drunk driving accident in which the accused is a Massachusetts State Trooper.  This trooper was off-duty at the time of the alleged drunk driving accident, which occurred in Salem, Massachusetts, and it occurred in 2014.  Since this case is being tried as a felony in the Superior Court following an indictment, it is normal for some time to pass before trial, especially in a case such as this, where the trial judge just recused himself to prevent anyone from believing he is deciding on issues in a biased manner. Back in season two of American Idol, Clay Aiken, Ruben Studdard and Rick Smith were all part of the final eight contestants hoping to win the singing competition and reality show, back when the show was very popular.  While Smith did not win the contest that year, he did gain a great deal of fame and got started on his music career.rosemusic

Sadly, it was reported Smith was recently killed by an alleged drunk driver. That’s according to a recent news feature from ET Online.  Authorities have said Smith was in Oklahoma when he was involved in a wrong-way vehicle crash on Interstate 240.  The accident occurred around 3 a.m. when a GMC pickup truck heading in the wrong direction on the highway slammed into Smith’s Honda Accord. One of the big issues that has made its way to the United States Supreme Court is whether a driver can be charged with a crime for refusing to submit to an alcohol breath test when asked by police upon a showing of probable cause that the driver is under the influence of alcohol.

There is no question there is an increasing amount of support for tougher drunk driving laws in the Commonwealth of Massachusetts.  This is not surprising when we consider that more Americans have lost their lives in drunk driving accidents than they have in all recent wars combined. This means that there are lots of victims of drunk driving accidents, and a lot of family members who lost a loved one as a result of a serious drunk driving crash.

driving1-225x300A recent feature from the Lowell Sun looks at an effort now being made to increase the penalty for drunk driving in Boston and throughout the Commonwealth of Massachusetts.  This new proposed law deals with the use of ignition interlock devices being installed on cars. The devices require a vehicle operator to blow into a breath test tube to verify he or she is not intoxicated.  The test is required to start the vehicle, and it is also required at random points while driving. The reason for the random tests is that some drunk drivers will have a sober person blow into the tube to start the car, so they can operate the vehicle. Continue reading
